Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JLPT Master mobile application and related services (the "App"). Please read them carefully. By creating an account, tapping "I agree", or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Who we are

The App is operated by an individual developer based in Japan under the Nihongo Club Sakura brand ("we", "us", "our"). JLPT Master is the App name. You can reach us at nihongoclubsakura@gmail.com.

2. Eligibility and age requirement

You must be at least 18 years old to create an account or use the App. After sign-in and before using the App, we ask you to confirm that you meet this age requirement. If you are under 18, do not create an account or use the App. Permission from a parent or legal guardian does not waive this minimum-age requirement.

If you are 18 or older but have not reached the age at which you can enter into these Terms independently where you live, you may only use the App with the consent and supervision of a parent or legal guardian where local law requires it.

3. Your account

You may sign in using Apple, Google, or an email address and password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at the email above if you suspect unauthorized use.

4. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for your own non-commercial study purposes. The App is available on Apple's App Store, and your use is also subject to Apple's standard Licensed Application End User Licence Agreement ("EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms and Apple's EULA conflict, the stricter provision applies.

Except for content you submit and third-party materials, all rights in the App, including the software, questions, explanations, study content, design, our names, our logos, and other materials, are owned by us or our licensors. We do not grant you any rights except the limited licence stated in these Terms.

5. Things you agree not to do

You agree not to:

• copy, modify, reverse-engineer, decompile, or create derivative works of the App except where such restriction is prohibited by law;
• resell, sublicense, rent, or commercially exploit the App or its content;
• use the App to break any law or infringe anyone's rights;
• attempt to gain unauthorized access to our systems, disrupt the service, or circumvent usage limits, paywalls, or security measures;
• upload unlawful, abusive, or infringing content.

6. Study content and accuracy

The App provides practice questions, mock exams, scoring estimates, and study analytics for the Japanese-Language Proficiency Test (JLPT). The JLPT is administered by third parties. "JLPT" and "Japanese-Language Proficiency Test" are used only to identify the exam you are studying for; we are not affiliated with, endorsed by, or sponsored by the official JLPT organizers. Scores, JLPT-style scaled score estimates, level estimates, and pass predictions are estimates for study purposes only. They are not official JLPT scores, are not official JLPT-equivalent results, and do not guarantee any result on the official examination. Our scoring methods, formulas, item parameters, and analytics may change over time.

We add, expand, update, and correct study content (including questions, mock exams, and additional JLPT levels) on an ongoing basis. We do not guarantee that any particular content, level, or feature is or will be available at any given time, or that it will be released by any particular date.

7. User-submitted content

The App lets you report questions or submit feedback. You are responsible for what you submit and grant us a worldwide, royalty-free licence to use it for operating and improving the App. Do not submit anything you do not have the right to share.

8. Subscriptions, purchases, and billing

The App offers optional paid subscriptions and in-app purchases that unlock premium features.

• Billing is handled by Apple through the App Store, not by us. Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal: subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period.
• Managing or cancelling a subscription is done through your Apple ID settings. Deleting your in-app account does not automatically cancel an App Store subscription.
• Refunds are decided by Apple under its App Store policies; we cannot issue refunds for App Store purchases. If Apple grants a refund, your premium access for the refunded period will be revoked.
• What a subscription covers: an active subscription gives you access to the premium content and features available from time to time. New content and JLPT levels we release are added to your active subscription at no additional charge. We do not commit to any release date, and the value of the subscription is the access provided while it is active, not any specific future content.

The price, billing period, trial terms if any, and renewal terms are shown in the App Store purchase sheet before you confirm. Prices and offerings may change; changes do not affect a period you have already paid for unless Apple or applicable law allows otherwise.

9. Virtual items, XP, and in-app rewards

The App includes a rewards system that may grant experience points ("XP"), badges, mock-exam credits, and other virtual items (together, "Virtual Items") for activity such as completing practice sessions, finishing mock exams, or watching rewarded ads.

Virtual Items:

• have no monetary value, are not your property, and represent only a limited, personal, revocable, non-transferable licence to use them within the App;
• cannot be sold, traded, transferred, gifted, or exchanged for cash or anything of value, inside or outside the App; and
• are not money, bank credit, securities, or any stored-value or payment instrument.

Because the rewards system is part of how we design, balance, and operate the App, we may change it at any time, at our sole discretion, without prior notice and without liability to you. This includes, without limitation, the right to:

• adjust how much XP or how many credits any activity earns, including the formulas, rates, multipliers, and caps used to calculate them;
• set, shorten, extend, or remove expiration dates for XP, credits, or other Virtual Items, or cause them to expire;
• modify, suspend, reset, recalculate, or revoke Virtual Items, including where we reasonably suspect error, abuse, or a breach of these Terms; and
• limit, suspend, or discontinue the rewards system entirely, in whole or in part.

We are not required to give advance notice of these changes, and we will not owe you any refund, compensation, or replacement for any change to, reduction in, or expiration or loss of Virtual Items. Virtual Items are not part of any paid subscription or purchase; your paid entitlements are governed by Section 8 and are not reduced by changes to the rewards system.

10. Advertising

The free tier of the App may show advertising provided by third parties, including Google AdMob. Ads may include banner, interstitial, and rewarded ads. Rewarded ads are optional; rewards are granted only when the ad network confirms completion, and we do not guarantee that a rewarded ad will always be available. Where required, we ask for your consent to personalized advertising before showing such ads. See our Privacy Policy for details.

11. Changes to the App and these Terms

We may add, change, or remove features at any time. We may also update these Terms. When we make material changes, we will update the version and "last updated" date and, where appropriate, ask you to accept the updated Terms before continuing to use the App. Your continued use after an update means you accept the revised Terms.

12. Termination

You may stop using the App and delete your account at any time from the Privacy Center. We may suspend or terminate your access if you breach these Terms or use the App in a way that could harm us or other users. Account deletion does not cancel an App Store subscription and may not remove records we must retain for legal, tax, security, fraud-prevention, or dispute-resolution purposes, as explained in our Privacy Policy.

13. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that study results will be achieved.

14. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or study outcomes arising from your use of the App. Nothing in these Terms limits liability that cannot be limited by law.

15. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. Many countries give you local statutory rights that these Terms do not override.
